Please read the following Terms and Conditions carefully before you use this website. They contain important information about your rights and obligations as well as limitations and exclusions that apply to your purchases.

This website ("feelfreekayak.co.nz") is operated by KAYAKER Limited (referred to in these Terms and Conditions as "The Company", “Ourselves”, "we" and "us”). “Customer", “You” and “Your” refers to you - the person accessing this website and accepting the Company’s terms and conditions.
These terms and conditions apply to all purchases of products via our website, in our premises at the trade shows, demo days and other events.
We may ask your personal information for the following reasons:
• if you agree to create an online account with us
• if you use our website contact form - when you enquire about our product or services
• if you subscribe to our newsletter
• to process your orders and to keep record of your purchases
• to add you to our customer database so you can receive information on specials, events and promotions.
We will not disclose you personal information to anyone except for:
• passing your contact details onto delivery services and courier operators
• when we are required to do so by New Zealand law
Should you decide you no longer wish to receive our e-mails, please click on to the unsubscribe link at the bottom of the email, or simply reply saying you wish to unsubscribe.
All prices published on this website are in New Zealand Dollars (NZ$) and include 15% Goods and Services Tax (GST).
We can deduct the GST on overseas purchases on an individual basis – if requested in advance as this website is not set to deduct the GST automatically. We will deduct GST from the price if we are delivering the goods to an overseas address. We will not deduct GST if overseas customers collect their goods in person or if we are delivering to a New Zealand address.
Kayaker Limited cannot guarantee availability of all products, and cannot guarantee that all items will be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, offer a similar product.
We make an effort to make all information on this website as accurate as we can. However, in the event a product is listed at an incorrect price or with incorrect information due to a typographical error or an error in pricing or product information, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.
When we receive your purchase order you will be notified by email. We review all purchase orders to ensure they are complete and that they include all contact information we need for the delivery. We will contact you if we need any more information to process your order. Complete orders are processed within 48 hours (excluding weekends and working days).
Please note that we only despatch orders that have been paid for in full, including the freight charges if applicable.
If all item(s) you ordered are in stock we despatch your order within 2 business days. If for some reason any of the items you ordered are out of stock, we will contact you to offer one of the following solutions:
offer an alternative product, make a back order, issue a full or partial refund.
We deliver products nationwide within 72 hours from time of order.
Delivery costs vary with your location. We have delivery rates per volume/weight for the North Island NZ and delivery rates per volume/weight to destinations in the South Island NZ. We have a surcharge for rural deliveries.
North Island URBAN – max 2 days delivery
North Island RURAL – max 3 days delivery
South Island URBAN – max 3 days delivery
South Island RURAL – max 4 days delivery
We deliver on business days (Monday to Friday). Saturday deliveries are available on request.
Sunday deliveries and deliveries on public holidays are not available.
Please contact us for delivery options to Stewart Island and any other outer island in NZ before you make an order.
For all shipments, the title to products and risk of loss or damage passes from KAYAKER Ltd onto the customer upon delivery by the shipping company.
SHIPPING AND HANDLING
Shipping charges are applied additionally to all online orders. The amount is generated by computer, based on the weight and size of your shipment. A Rural Delivery surcharge is charged on all deliveries requiring rural delivery.
KAYAKER Ltd reserves the right to charge handling or packaging charges on some items such as fragile goods and dangerous goods.
Should you have any questions or concerns regarding these charges, please contact us.
All products purchased from KAYAKER Limited (whether via this website or not) are covered by a 12 month warranty. Some products have an extended manufacturer’s warranty. The warranty covers all faults in material and workmanship and will be remedied to the owner at no cost provided the faulty product is returned together with the copy of a receipt or invoice and within the warranty period.

The warranty period starts from day of purchase
At KAYAKER Ltd we pride ourselves on selling only good quality products, but we know that occasionally things can go wrong. If you receive a faulty product we will either repair it or replace it, depending on the nature of the fault. Please note that we will only refund on a faulty item if it is not repairable and if it is discontinued. Either way we need to receive the item back to inspect it.
If the fault occurs during the warranty period and after the product has been in use, please contact KAYAKER Ltd or the retail store where you purchased it to claim your warranty.
If you purchased your product from any of our dealers, please return it to the store where it was purchased.
If you purchased directly from KAYAKER Limited (whether via this website or not) please contact Kayaker Limited at 06 323 4000 as soon as you can. We will talk you through the options you have and will ask you to send the product back to us to KAYAKER Limited. Strictly delivery with signature only.
All received warranty claims are inspected and in some cases we may ask the manufacturers opinion. We offer the following options on approved warranty claims (in this order):
• repair of the product
• replacement with an identical product
• if the product is not any longer available, we may offer an alternative product or a refund.
Please choose carefully as we do not refund money if you simply change your mind. We will however help you exchange a product if you have purchased the wrong size, or if the product that does not suit your needs exactly. We will endeavour to find the correct product size for you or a product that will suit you better.
If you would like to return any products purchased from Kayaker Limited you must notify us prior by phone 06 323 4000 or by email firstname.lastname@example.org. Only after we provide you with a Return Authorization Number, you can send the product back to us. Strictly delivery with signature only. The returned product(s) must be:
• received in new condition, unused and complete including all accessories included with the product
• received in its original inner and outer packaging
• received with the original or a copy of the invoice, receipt or other proof of purchase
• received within 14 days of the date of purchase.
It is the customer’s responsibility to pay for shipping of the returning item(s).
KAYAKER Limited reserves the right to refuse the return of incomplete, damaged, used or otherwise non-conforming returns or to charge a restocking fee for such non-conforming returns.
For the purpose of the return and refund policy the boats that have been put on water are considered used.
Items purchased on special can’t be returned and are non-refundable.
Please note that we only refund approved warranties and once we have explored all other ways of making the product good for you. We will repair the product, if it is repairable; we will replace the product, if it is not repairable and we will offer an alternative or better product if the identical product is no longer available. We take up to two working days to determine if you are eligible for a refund or if we can make it good.
If you are eligible for a refund we will credit your credit card account or reverse the original method of payment within 3 working days. The funds will be available in your account in the following day(s) depending on efficiency of the banks involved.
Freight charges and packaging charges are not refundable.
LIMITATION OF LIABILITY
In no event shall Kayaker Ltd be liable for damages, loss of business or profit, harm of health, injury or death in relation to the use of any product purchased from this site at the trade shows, demo days or through any of our dealers.
We will endeavour to solve all customers issues by mutual agreement. In the case the agreement can’t be reached, in the case of a dispute, controversy or claim arising out of or relating to your purchase of any product from KAYAKER Ltd, New Zealand law applies.
